CAI's Pennsylvania Legislative Action Committee presents our annual Legal & Legislative Symposium.
On May 4, 2018, Governor Tom Wolf signed House Bill 595 into law. Now known as Act 17 of 2018, this legislation assigns the investigation and mediation of certain complaints regarding planned communities, cooperatives, and condominiums under the state’s common interest community statues to the Pennsylvania Office of Attorney General’s Bureau of Consumer Protection. The legislation permits unit owners in good standing to file a complaint with the Bureau in the event of a violation by either the declarant or the association of sections of the statutes related to meetings, quorums, voting, proxies and association records. The legislation also requires a complaint to first go through a community association’s alternative dispute resolution (ADR) process, if one exists. This symposium will provide a full explanation of the various provisions of the new law, how it may affect your community association, and provide information on how your community can adopt an ADR program.
The following legislation, sent to Governor Wolf in October, will also be reviewed:
- House Bill 1499 - omnibus amendments re: powers of the association; conveyance of common elements; declarant's warranty against structural defects; and more.
- House Bill 2409 - Documentation of service animals.
We will also review recent judicial cases from around the nation that may have an impact on Pennsylvania’s community associations.
